PRIVACY POLICY

 

LEARNontherun is fully committed to protecting Users' privacy. Our Privacy policy describes our privacy practices when Users use our services or interact with our Websites.

 

Our Privacy Statement

LEARNontherun is a service that allows registered learners ('Learners') to enrol in small online group or individual classes and for registered teachers, trainers or instructors ('Instructors') to create, publicise, and provide these classes ('Services'). Learners can be adults or children who have been registered by their parents or legal guardians ('Parents') to enrol in the Services offered by LEARNontherun.

 

This Privacy Statement describes the personal information LEARNontherun collects from registered Parents, Instructors, and Learners ('Users') of the LEARNontherun's Services. It also describes how LEARNontherun collects and uses personal information from visitors to our websites ('Websites'). 

 

Information We Collect

When Users visit our Websites, we may collect information about Users that, alone or in combination, could be used to identify a User, a User's Learner or a User's device ('Personal Data'), as described below:

 

Personal Data provided through the Website: We collect Personal Data from Users when they directly provide it to us, such as when they register for an LEARNontherun account to use our Services. These data includes the following:

 

Contact Information

  • Name or publicly posted name from a Facebook linked account
  • Email address
  • Phone number
  • Postal address and billing address

 

Payment Information

  • Credit card or other payment information 

 

Demographic Data

  • Age
  • Date of Birth
  • Gender
  • Marital status
  • And other demographic details, which Users may voluntarily provide in the ‘about me’ section of their profile or when they communicate with us.

 

Sensitive Data

  • Voluntarily provided sensitive information such as health status or disability information in enrolment or communication forms, or messages sent to Instructors to aid with learning. Instructors and Learners are otherwise not allowed to have discussions that may elicit or result in sharing of sensitive information.
  • Enrolment in classes offered for children with disabilities or special-needs. 
  • Possible sensitive criminal history information about Instructors when we receive our routine background reports for registered instructors.

 

Content and Files

  • Enrolled Classes for Learners.
  • Video of Users' image and audio of Users' voice during classes which are automatically recorded
  • Content and communications that Users may include or upload such as their profile photo or messages they  share with the class
  • Profile picture voluntarily provided by Users or their Facebook picture linked to their account
  • Information voluntarily provided in the ‘About Me’ section of Users' profile
  • Information voluntarily provided through reviews
  • Information Instructors provide for background checks and background check reports we receive from third parties.
  • Notes Users provide to Instructors about themselves or their Learners when enrolling in a class.

                                      

Required Personal Data: 

  • Credit card payment used by Parents to purchase classes and for verified parental consent. 
  • Instructors are required to let us access Personal Data relating to background checks.
  • Instructors are required to have their cameras on while teaching a live class. 
  • Learners are required, subject to authorized exceptions, to have their video enabled at least at the start of class to verify their identity to protect the safety of other Learners in the session. 

 

 

Passively Collected Data: When Users use our Websites or our Services, we and our third-party partners may collect, receive, and store certain data automatically. These data includes the following:

 

Usage data. These include, but not limited to, login times, search terms used, pages viewed, and other information about Users' device and browser.

 

Identifiers and device information. These include, but not limited to, IP Address, device identifiers such as cookie identifiers, device's operating system, and browser. Such information may be pooled with other information to track usage and device and system data. Examples of such data include total number of visitors to our Websites, the number of visitors to each page of our Websites, and the domain names of Internet service providers of Users.

 

Cookies. On our Websites, both our third parties and us may use cookies to provide certain functionalities to the LEARNontherun Websites and help us analyze our website usage patterns more accurately. Users may turn off cookies by following the information on their browser's ‘help’ section. However, we recommend leaving cookies turned on because they allow Users to take advantage of some of our Websites' features. For more information about our use of cookies, please see the ‘Cookie Policy,’ section.

 

Inferred and Aggregated Personal Data: We may infer new information from the data we collect, including using passive, automated means, to generate information about Users' likely interests ('inferences'). For example, inferring the type of classes Users may be interested in based on searches performed. We may also infer general geographic location (such as city, state, and country) based on User's IP address. We may also aggregate data, including Personal Data, and use such aggregated data for any purpose. This aggregate information does not identify individual Users.

 

Sources of Personal Data

Users are the main source of the Personal Data we have about them. We may also obtain any of the above categories of information from third parties. These third-party sources include, for example:

  • Third party partners. Third party applications and services, including social networks Users choose to connect with or interact with through our services.
  • Co-Branding/Joint Partners. Partners with which we offer co-branded services or engage in joint marketing activities.
  • Service providers. Third parties that collect or provide data in connection with work they do on our behalf, for example companies that determine User device's location based on its IP address.
  • Publicly available sources. Public sources of information such as open government databases and background check services we use for Instructors.

 

Our Use of Users Personal Data and Other Information

We may use any of the above categories of Users' Personal Data to:

  • Maintain and enhance the LEARNontherun Websites, including conduct of maintenance works, improvement works and personalization of the Websites;
  • Conduct business operations, such as processing payments for the LEARNontherun Services, billing, accounting, improving our internal operations, securing our systems, detecting fraudulent or illegal activity, and meeting our legal obligations;
  • Send Users emails or newsletters that they have signed up for, including messages about new and recommended classes, events, and other marketing content we may send to Parents, Learners and Instructors;
  • Communicate with Users to confirm registration and send updates, provide customers support and security alerts, and other administrative messages;
  • Conduct research and develop new services or features; analyze website usage and usage of the Site features, content, and pages;
  • Conduct background checks for Instructors
  • Combine data collected from different sources to achieve the above purposes and to give Users a personalized experience when using our Websites and Services.

 

 

LEARNontherun may use contact data of Users for marketing purposes, including informing users about services and opportunities that may be of interest to them. If we do so, each promotional email we send to users will contain instructions permitting them to "opt-out" of receiving future promotional information. In addition, if at any time users wish to no longer receive any future communications or wish to have their contact information included in our opt-out lists, please contact us at support@LEARNontherun.com. Please note that we will still continue to contact users via email to respond to requests and provide our services.

 

Storage and Transfer of Personal Data

User information, including Personal Data, may be transferred to and maintained on computers located outside of an individual User's country, or other governmental jurisdiction where the data protection laws may differ from those in their region. If Users are located outside Singapore or the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and/or Singapore and process it there.

 

Our Disclosure of Users Personal Data and Other Information

We may share users' Personal Data with certain third parties with their consent or authorization and with whom they have intentionally interacted. We may share users' Personal Data as necessary to complete their transactions and provide the services they have requested or authorized. For example, we use third parties to process credit card payments.

 

We may also share data as set forth below:

 

Instructors and Organizations: When Learners or Parents sign up they agree that Instructors may receive certain Personal Data about the Learners including classes taken previously. Instructors are not our employees, agents, or service providers, but we do issue guidance and restrictions on what they can do with Personal Data. We act as limited agents for our Instructors to process payments from Learners or Parents for Classes. Please note that in some cases, classes are taught by an ‘Instructor’ that is actually an organization, group, or team of instructors ('Instructors Organization').

 

Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, User information may be transferred to a successor or affiliate alone or as part of that transaction along with other assets.

 

Service Providers: We engage third party service providers to perform certain functions on our behalf (such as payment processing). These third parties may have access to Users' Personal Data for the purpose of marketing, providing service and improving our Websites.

 

Legal Requirements: LEARNontherun may disclose Users' Personal Data if required to do so by law or when we believe that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of LEARNontherun, Instructors, Learners, and Parents, (iii) operate and maintain the security of our Websites, including to prevent or stop an attack on our computer systems or networks, (iv) to protect the personal safety of Users of the Site or the public, or (v) protect against legal liability. Instructors are required to report to LEARNontherun any suspected case of child abuse or neglect they become aware of during their work with Learners. Instructors may also be required to report suspected abuse or neglect to local authorities, and LEARNontherun expects all Instructors to comply with their individual reporting responsibilities. LEARNontherun itself may report instances of suspected abuse or neglect.

 

Third Party Analytics and Advertising Companies: 

Third party analytics and advertising vendors also collect Personal Data through our Website including, general location data, usage data, and inferences associated with identifiers and device information (such as cookie IDs and IP address) as described in the Cookies section. These third-party vendors may combine this data across multiple Websites to improve analytics for their own purpose and others. For example, we use Google Analytics on our Website. Users can learn how Google collects and uses information at www.google.com/policies/privacy/partners. Our Website also includes references or links or suggestions to engage with third parties whose privacy practices differ from ours. Instructors may also suggest third party resources for Parents and Learners. If Users provide Personal Data to any of these third parties, or allow us to share Personal Data with them, that data is governed by their privacy statements.

Publicly Posted Information

While using our Services, Users may be able to obtain and share Personal Data, including communications, with third parties, including the general public. When sharing information in such a manner, we urge Users to avoid sharing Personal Data. We expect all Users to respect the privacy of others and follow our community standards, and other guidelines and restrictions on posting and sharing activities, such as sharing private materials, communications, or information, or sharing Personal Data about others that may cause harm, embarrassment, or conflict. 

User Profile:  Users of our Services will have a ‘User Profile’ that will be publicly available to all other Users of our Services. Users are not required to include any Personal Data on their User Profile. But they may choose to include a variety of types of Personal Data such as name, demographic information, location, and a profile picture. We do not systematically monitor the content published in Users' User profiles. We would like to highlight that any information published in a User Profile becomes available to the general public and after publishing, LEARNontherun has no control over how such information is used. We urge Users to think carefully about the Personal Data they include in their User Profile, if any.

Online Classrooms and Pages: Users attending our online classes, may publicly display and share their name and/or Username and other information, such as their profile, demographic data, content and files, and imprecise location data.

Public Forums: Our Services provide Users the opportunity to share information on a variety of topics with other LEARNontherun Users through the public ‘Forums’. Use of the Forums is entirely voluntary. Users should note that any information shared in the Forums will be available to all LEARNontherun Users without restriction. We do not systematically monitor the content published in the Forums. Any information published in the Forums becomes available to general the public and after publishing, LEARNontherun has no control over how such information is used.

Social Media: Users may log into our Website and use our Services using a Facebook or Google account. When Users login, we will receive their name, profile picture and email address from Facebook or Google, and Facebook or Google will record when we access this data. Users will provide their login information directly to Facebook or Google (and not to LEARNontherun). How Facebook or Google uses, stores, and discloses Users' information is governed by the policies of Facebook and Google respectively; LEARNontherun does not have responsibility for the privacy practices or other actions of Facebook or Google.

 

Security

We take reasonable steps to protect the Personal Data provided via the Website from loss, misuse and unauthorized access, disclosure, alteration, or destruction. However, the Internet cannot be guaranteed to be fully secure, and we cannot ensure or warrant the security of any content or information Users provide to us. Users are also responsible for helping to protect the security of their account credentials. For example, Users should never give out their password, and safeguard their Username, password and personal credentials used to access the Services, so that others will not have access to their Personal Data. Users should not use the Username and password used for our Services for any other platforms or services.

 

Do Not Track

Do Not Track is a preference users can set in your web browser to inform websites that you do not want to be tracked. While we do not currently support Do Not Track signals, we treat the data of everyone who comes to our site in accordance with this Privacy Statement, whatever their Do Not Track setting.

 

Access and Accuracy; Correcting Personal Data.

We use reasonable efforts to keep Users' Personal Data accurate and up-to-date, and we provide Users with options to correct, amend, delete, or limit the use of their Personal Data. As appropriate, this amended Personal Data will be transmitted to those parties to which we are permitted to disclose Users' information. Having accurate Personal Data enables us to give Users the best possible service.

 

Retention of Personal Data

We retain Personal Data for as long as necessary to provide the services and fulfill the transactions requested by Users, comply with our legal obligations, resolve disputes, enforce our agreements, and other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as User expectations or consent, the sensitivity of the data, the availability of automated controls that enable Users to delete data, and our legal or contractual obligations. For example, we keep Class Recordings for up to six months after the date of the applicable Class.

What are cookies?

Cookies are small text files that uniquely identify a User's browser or device. Cookies are used with web beacons (or similar technologies), which are electronic images contained within a website and can read cookies they place on a User's device.

 

What are cookies used for?

Cookies allow a site or service to know if a User's computer or device has visited that site or service before. Cookies can then be used to help understand how the site is being used, help Users navigate more efficiently between pages, remember User preferences, and generally improve the browsing experience. We and our analytics and advertising partners use cookies and other identifiers, such as IP address, and technologies on our Websites to collect Personal Data (such as the pages visited, links clicked on, and other usage information) when Users use our Websites, including Personal Data about your online activities over time and across different websites or online services. We and our analytics and advertising partners may use cookies and similar technologies to provide targeted advertising.

 

How to control and review cookies

LEARNontherun uses third-party analytics and advertising providers on our website and in our emails. When using our website, Users will be prompted to give their consent for the use of cookies while using our Services. Please note that the consent given for using cookies is specific to the browser and device. If Users access our website from multiple devices or browsers, they will ask for consents for each of these devices and browsers.

 

Other Terms and Conditions

Users' access to and use of our Websites is subject to our Terms of Service.

 

Changes to Our Privacy Statement

We may change this Privacy Statement at any time. If we decide to change this Privacy Statement in the future, we will post or provide an appropriate notice. If we make material changes to the statement, we will provide notice or obtain consent regarding such changes as may be required by law. The date on which the latest update was made is indicated at the top of this document.
